The SWIB (Semantic Web in Libraries) forum is an online platform for open communication within the SWIB community. The forum is technically operated by the North Rhine-Westphalian Library Service Centre (hbz) in Cologne. The purpose of the forum is to provide an exchange and networking platform for the public on Linked Open Data (LOD) in libraries and related organizations.

The forum is aimed at people who

  • work in libraries and related organizations,
  • participate in SWIB conferences,
  • are looking for exchange,
  • need or want to give advice and support on SWIB-related problems at work.

The aim is to facilitate and document the community exchange during and between SWIB conferences. We also want to create a space in which everyone, regardless of their expertise, is invited to ask questions about Linked Open Data (LOD) in libraries and related organizations and get the best possible help.

§ 1 Scope of application

  1. These terms of use govern the rights and obligations of registered users and the hbz as the technical operator of the forum.

  2. The forum is aimed at all those interested in SWIB and is intended for constructive exchange within the SWIB community. The content shared must be thematically related to metadata.

§ 2 Registration and admission

  1. Use of the forum is free of charge.

  2. There is no entitlement to registration and admission as a registered user. The hbz is entitled to reject registration applications if a violation of these terms of use has occurred or is to be expected.

  3. The user fills out the registration form and receives an email with a link to the forum to confirm the registration. With the subsequent confirmation in the forum, the registration is complete. By logging into the system for the first time using a password, the registered user agrees to the Terms of Use and the Privacy Policy and is thus admitted. If the Terms of Use are updated, the registered user will be notified of the changes in advance by email. By subsequently continuing to use the platform, the registered user also agrees to the changes.

  4. Registration and admission establish a user relationship between the hbz and the registered user.

  5. In the case of registration, the registered user is obliged to fill in mandatory fields truthfully and completely, to keep his or her data up to date and confidential and to protect it from access by third parties. In the event of a breach, the provisions of § 4 No. 6-10 shall apply in particular.

§ 3 Posting content

  1. The registered user confirms that the posted content and metadata do not violate any third-party rights (e.g. copyrights, rights of performers, personal rights, data protection). If others are involved in the production, the registered user confirms that all contributors are aware of the content of this agreement and agree to it. By posting their own content, the registered user assures that the publication does not conflict with any third-party rights. When uploading third-party content, the registered user assures that he/she has the consent of the rights holder or other authorization to upload.

  2. Furthermore, the registered user assures that the content published by him/her does not violate applicable law or morality, in particular that it does not constitute a criminal offense or an administrative offense (e.g. violation of copyright law, trademark law, competition law) and that it does not contain any offensive, discriminatory, racist, pornographic or extremist content. In the event of a violation, § 4 no. 8-10 shall apply in particular.

  3. If the registered user becomes aware of an infringement within the meaning of § 3 No. 2, he/she is obliged to inform the hbz immediately (see contact form under About us - metadaten.community).

  4. The registered user shall indemnify the hbz against all claims by other registered users or third parties asserted against the hbz for infringement of their rights by materials posted by the registered user. In this case, the registered user shall bear the costs of a reasonable legal defense of the hbz. This does not apply if the registered user is not responsible for the infringement. In the event of a claim, the registered user is obliged to provide the hbz immediately, truthfully and completely with all information necessary for the examination of the claims and a defense.

  5. The user relationship can be terminated at any time and without notice by sending an email to the hbz using the contact details provided on the About us - metadaten.community page. All user profile data will be deleted immediately in the event of termination. The posted content will not be deleted. If desired, a use can delete his content independently before the termination of the user relationship.

§ 4 Rights and obligations of the hbz

  1. Subject to a more extensive license, the registered user grants the hbz the non-exclusive right, free of charge, to electronically store, reproduce, publicly present, edit and make publicly accessible via its portals in data networks worldwide free of charge for downloading or viewing, as well as to use the material for its own advertising purposes, in whole or in part (e.g. individual images, excerpts, sound) for the aforementioned purposes. In addition, the hbz may also reproduce the materials for the above-mentioned purposes on all technical, digital and analog systems in all formats and on all carrier media and distribute them worldwide and also use them within the scope of currently unknown types of use.

  2. The hbz assumes no liability that the platform and its content will always be available without interruption, unchanged and in full, or that it is up-to-date and free of editorial or technical errors. No liability is accepted for damage caused by reliance on the content of the platform or its use.

  3. The hbz reserves the right to change the range of functions, the appearance of the platform and these terms of use at any time. Registered users will be informed of the changes in advance by email. By continuing to use the platform, the user agrees to the changes.

  4. The hbz is entitled to terminate its service at any time. In this case, the hbz reserves the right to delete the content of registered users. However, this does not result in an obligation to delete the content.

  5. The hbz is only liable for damages caused by intent and gross negligence. Statutory provisions apply in the event of injury to body and health.

  6. Liability for damages resulting from unauthorized use of password-protected logins by third parties is not accepted.

  7. Insofar as liability is limited or excluded, this also applies in favor of employees, representatives and vicarious agents of the hbz.

  8. If there are concrete indications of a breach of these terms of use, the hbz is entitled to delete content, restrict the use of the services or block the registered user concerned. When choosing a measure, the legitimate interests of the registered user will be taken into account, in particular whether there are indications that the registered user is not responsible for the violation.

  9. The hbz may block or delete content that contains a legal violation in accordance with § 3 No. 1 and No. 2.

  10. The hbz is entitled to withdraw the registration of the registered user, thereby revoking the authorization and deleting the account, if a violation of these Terms of Use has occurred or is to be expected. The right to block remains unaffected by this.

§ 5 Miscellaneous

The user relationship and these terms of use are subject to German law.

The place of jurisdiction is Cologne.

In the event of disputes, the hbz will endeavor to reach an amicable settlement.
